Automated license plate readers (ALPRs) assist law enforcement in locating stolen vehicles, finding missing persons, and generating leads in criminal investigations. However, recent controversies surrounding cameras underscore the necessity for robust policies regarding access and usage of this technology.

This issue is particularly pertinent to the drone industry, as Flock is a participant in the (DFR) market. Various agencies globally are adopting drones from multiple vendors to enhance real-time situational awareness and improve outcomes. The challenges posed by license plate readers are similarly applicable to DFR systems.

Functionality of Flock Cameras

‘s ALPRs capture images of vehicles on public roads, recording license plates and vehicle characteristics such as make, model, color, and body type. Investigators can utilize this data to identify vehicles linked to crimes or missing-person cases. Additionally, agencies receive alerts when a detected plate matches an approved hotlist.

Flock reports that its cameras assisted in cases involving 1,000 missing individuals and 20,000 stolen vehicles in July alone. Importantly, these cameras do not employ facial recognition technology or identify a person’s race or gender. However, the extensive network of cameras raises privacy concerns, as the combination of searchable records and inter-agency information sharing can reveal a vehicle’s travel history.

This investigative capability, while beneficial for solving crimes and enhancing community safety, necessitates stringent controls over access.

Recent Misuse Cases Raise Oversight Questions

Several recent incidents have highlighted the potential for misuse of ALPR technology. In New Bedford, Massachusetts, the police department suspended its use of Flock technology after an officer was accused of tracking an ex-girlfriend using the system, a claim the officer denies. The department acknowledged the value of Flock as an investigative tool while also recognizing legitimate concerns regarding privacy, access, information sharing, and oversight.

According to reports, at least 50 officers have faced allegations, charges, or convictions for misusing Flock or other license plate reader systems, with accusations involving searches related to romantic partners and former spouses.

Concerns about information sharing have also emerged. In Utah, records obtained by the Utah Civic Compact revealed that 10 cameras in Weber County had been searched over five million times since early 2022, with most searches originating from law enforcement agencies outside the state. This has prompted calls for stronger state regulations.

These cases raise critical questions about who is authorized to search the system, the purposes of such searches, jurisdictional boundaries, data retention periods, and auditing processes.

Flock Implements New Safeguards

The issues surrounding misuse stem from individual actions rather than flaws in the system itself. In response to public backlash, Flock is introducing additional safeguards. CEO Garrett Langley announced that several controls, previously optional, will become mandatory for law enforcement agencies by January 1.

These measures include the implementation of an auditing system to identify unusual search patterns, requiring searches to be linked to criminal cases, and the potential for user lockouts during reviews of questionable activity. Additionally, Flock plans to reduce the standard data retention period from 30 days to seven days, although information related to active cases can be preserved as evidence.

Langley emphasized the responsibility to protect the public from the misuse of powerful tools by a minority of officers. Critics, however, argue that regulations governing police should be established through legislation and public policy rather than relying solely on technology vendors.

Implications for Drone Technology

The concerns raised by ALPR systems are equally relevant to DFR programs. Flock, which acquired Aerodome in 2024, is among the companies providing DFR technology. These systems enable agencies to deploy drones quickly to emergency situations, offering live aerial information before officers arrive on the scene.

While DFR systems are valuable tools for enhancing safety, they also integrate with various public safety technologies, including license plate readers. Unlike fixed ALPRs that monitor vehicles at a single location, drones can navigate through communities, altering their field of view and providing real-time aerial imagery.

The increased capabilities of these technologies highlight the importance of establishing clear usage guidelines.

Establishing Policies Prior to Deployment

For DFR programs, it is crucial for agencies to define operational rules before implementation. Policies should outline authorized uses, access to live and recorded imagery, data retention, information sharing, auditing processes, and prohibited activities. Transparency with the communities served is also essential.

Robust safeguards will enable agencies to utilize these technologies effectively for their intended purposes: responding to emergencies, investigating crimes, and enhancing public safety. The experiences with Flock’s network serve as a timely reminder that technology and the policies governing its use must evolve in tandem.
